Judge gives go-ahead to Abraham Lawsuit Against Arnold Smith

In another blow to Dr. Arnold Smith's bankruptcy gambit, the federal bankruptcy judge has lifted the "stay" against Lee Abraham's lawsuit for damages against Smith for his alleged attempt to have Mr. Abraham assassinated.

Smith was indicted for hiring hit-men to kill Abraham, but criminal proceedings against Smith have ground to a halt now that he has been declared mentally incompetent and committed to the state mental hospital at Whitfield.

The Bankruptcy judge has now ok'd Abraham proceeding with his civil suit against Smith: Order Lifting Stay

Smith's controversial bankruptcy filing had derailed Abraham's suit against him from going to trial this summer. But now the trustee has asked the court to dismiss the bankruptcy on the grounds that Smith isn't actually bankrupt. See Trustee Claims Arnold Smith Bankruptcy Filed in Bad Faith

So now Abraham's suit for damages against Smith will proceed, either in federal court or back in state court where it was originally filed in summer 2012. The Federal Court has pending a motion to "remand" the suit back to state court for a jury trial before Hon. Judge Breland Hilburn.
