The bankruptcy court judge has decided to exclude all members of the press from attending both the Express Grain auction and the sale hearing which began at 1:30 this afternoon.
The bankruptcy court clerk's office in Aberdeen informed The Taxpayers Channel of the final decision by the court just 15 minutes prior to the hearing start time. Yesterday, the court had already determined to exclude the press from this morning's auction of Express Grain's assets.
The press was excluded from attending in person at the Aberdeen court house, as well as from listening on the telephone call-in number.
No reason was provided for excluding the press from covering the auction and hearing.
The hearing is set to determine which bid or bidders to accept for the purchase of Express Grain's assets.
So far, there is nothing in the court docket to indicate which bids were made this morning at the auction, or how much was offered by the bidders.
Examination of the court docket does indicate the names of some of the bidders:
The Andersons, Inc.
Frank Brumfield
Roebuck Landing Grain Terminal, LLC
Thoroughbred AgriFuel Holdings, LLC
Farmers Grain Terminal is also represented by counsel, but it is unclear whether it tendered a bid.
In addition, UMB Bank has the right to place a bid at the auction. UMB Bank has indicated that it will participate in the sale hearing now going on.
