Perkins demands McAdams pay legal fees

Sheriel Perkins has filed the expected motion for legal fees against Greenwood Mayor Carolyn McAdams following the Court's ruling denying McAdams' Motion for Summary Judgment.

Perkins requests the Court order Mayor McAdams to pay her attorney fees in the amount of $6,440.

The latest filing comes in the long-standing Greenwood mayoral election contest filed in 2013 by Perkins against McAdams. McAdams, represented by Mark Garriga and Lem Montgomery of the Butler-Snow law firm, had requested Special Judge Henry Lackey to dismiss the election contest, but Lackey twice rejected their motions.

In his July 29, 2015 order denying McAdams' motion, Judge Lackey ordered her to pay Mrs. Perkins' legal costs, expenses, and attorney fees expended during Perkins' successful defense against McAdams' failed motions. Under the Mississippi Rules of Civil Procedure, when a party tries but fails at a summary judgment motion, the opposing party may be awarded the costs of successfully defending against it.

Perkins is represented by her husband, Willie J. Perkins Sr. The motion details the 32+ hours spent defending against the summary judgment motions, at a rate of $200 per hour.

As of this morning, no reply from McAdams' attorneys has been filed.
